Privacy Policy and Terms of Use for Waseet Alkol Platform
Introduction
This document constitutes a legally binding agreement between Waseet Alkol platform (hereinafter referred to as the "first party"), and the users, whether individuals or entities (hereinafter referred to as the 'User' or 'You'). These terms set the conditions for using the platform and the privacy policies related to the real estate brokerage services. The platform is licensed by the General Authority for Real Estate in the Kingdom of Saudi Arabia. The platform operates in accordance with the Real Estate Brokerage Law issued by Royal Decree No. (M/130) dated 30/11/1443 AH, its Executive Regulations, the Anti-Cyber Crime Law, and other relevant regulations. By accessing and using the platform, you agree to these terms, whether you have an account or not. This agreement starts from the first time you use the platform. Any changes to these terms will take effect as soon as they are announced, unless stated otherwise. If you keep using the platform after the changes, it means you accept the new terms.
Definitions
Platform: [Waseet Alkol], an electronic platform licensed by the General Authority for Real Estate to provide real estate brokerage services, including listing properties for sale or rent, real estate marketing, and advertisement management.
Real Estate Broker: An individual or entity licensed by the General Authority for Real Estate to carry out real estate brokerage activities.
User: Any natural or legal person who uses the platform, whether as a property owner, broker, buyer, or tenant.
Brokerage Agreement: A written contract between the broker and the parties to the real estate transaction that specifies the terms of the agreement.
Personal Data: Any information relating to an individual who can be identified directly or indirectly, in accordance with the Personal Data Protection Law in the Kingdom.
Third Party: Private entities or Semi-governmental entities (such as the Ejar platform or the Real Estate Exchange) whose technical solutions are used to facilitate the services provided through the platform.
1. Legal Capacity
- The user must be an adult (18 years or older) and have full legal capacity.
- Real estate establishments must be registered with the General Authority for Real Estate and hold a valid commercial registration that includes real estate brokerage activity.
- Users must provide accurate and up-to-date information when registering through the National Access Platform (Nafath) or any other approved method.
2. Services Provided
The platform provides real estate brokerage services, including:
- Brokerage to complete sales, purchase, and rental transactions.
- Real estate marketing and management of property advertisements.
- Services are provided in accordance with the licenses issued by the General Authority for Real Estate, including the "Fal" license for brokerage and real estate marketing.
- Specific permissions are granted to each category of users based on the type of account (Advertiser / Ad Recipient / Real Estate Broker / etc.).
3. User Obligations
Registration: Providing accurate and up-to-date information when creating an account, and updating it when necessary.
Real Estate Advertisements:
- The advertiser must be the property owner or officially authorized by a valid power of attorney.
- Advertisements must be accurate, non-misleading, and limited to one property per ad.
- The advertiser must respect public morals in the advertisement.
- It is prohibited to advertise properties that are legally non-transferable or under construction unless the project is registered with the General Authority for Real Estate.
- The platform may delete any advertisement it considers—at its exclusive discretion—to be in breach of this policy or public order, without prior notice or warning. No one shall have the right to demand compensation or any other claims from the platform for any reason.
Confidentiality: Maintaining the confidentiality of transaction-related information and not disclosing it except with the written consent of the parties involved.
Compliance: Observing the Real Estate Brokerage Law, the Personal Data Protection Law, the Anti-Cybercrime Law, and all applicable regulations in the Kingdom.
Accuracy of Information and Documents: The user acknowledges full responsibility for the accuracy of all information or documents submitted through the platform. The user alone bears legal and financial responsibility if the inaccuracy of such information or documents is proven.
4. Brokerage Agreement
The brokerage agreement must be in writing and include:
- Details of the parties, property details, contract duration, commission rate (not exceeding 2.5%), and mutual obligations.
- Real estate broker's license number.
- A copy of the contract shall be deposited on the electronic platform of the General Authority for Real Estate after the data is completed and approved by the parties.
- The contract duration is 90 days unless otherwise agreed, and it shall be considered void if not submitted to the Authority within the specified period.
5. Fees and Commission
Commission:
- The broker is entitled to the commission upon completion of the transaction within the contract period or within two months after its expiration, provided that brokerage is proven.
- The commission shall not exceed 2.5% of the transaction value or one month's rent for rentals.
Earnest Money:
- In case the deal is not completed, the broker is entitled to a percentage of the earnest money according to the stipulated regulations.
Third-Party Fees: The user acknowledges and agrees to bear any additional fees or costs related to services provided by third parties, whose technical solutions are used to deliver services through the platform. The user will be notified of these fees in advance when using the relevant services.
6. Personal Data Protection
Data Collection:
The platform collects the necessary personal data to provide services, including (but not limited to):
- Identity data (name, national ID number).
- Contact information (email, mobile number).
- Property data (deeds, ownership).
- Partial payment data (for payment processing).
- Interaction and browsing data on the platform.
Data Usage:
- The data is used to provide services, improve user experience, conduct analytics, marketing (with user consent), and comply with legal requirements. Data shall not be used for purposes other than those stated without the user's consent.
- Data is collected anonymously for statistical purposes without identifying the user.
Data Sharing:
The user acknowledges and consents to sharing data with:
- Other users (such as agents or owners) to facilitate transactions.
- Service providers (such as payment processors or analytics services).
- Public authorities when legally required.
Data Security:
- The platform implements advanced security measures to prevent data loss or unauthorized access, committing to due diligence without guaranteeing results.
- Access to data is restricted to authorized personnel only.
User Rights:
- Access to data and obtaining a copy of it.
- Correction of inaccurate data.
- Request the deletion of data (in specific situations).

Storage Duration:
- Data is retained as long as necessary to provide services or comply with legal requirements.
- Data is deleted or anonymized when no longer needed.
7. Management of Electronic Links
Links to the Platform: It is prohibited to create electronic links to the [Waseet Alkol] platform or any of its content, or to display them within a frame, without obtaining prior written approval from the platform management. The platform also reserves the right to impose conditions on any electronic link or disable it if the linked site contains illegal, inappropriate content, or violates intellectual property or privacy rights. Finally, the platform bears no responsibility for the content of linked websites.
Links from the Platform: The platform provides links to other websites or portals to enhance the user experience and is not responsible for the content or reliability of these sites. Use of these links is at your own risk, and the presence of a link does not imply the platform's approval or support of the content on other sites.
8. Advertisements
- Advertisements must be accurate, complete, and limited to one property available for sale or rent.
- The user is responsible for verifying the accuracy of advertisements before contracting.
- The platform holds the right to remove any advertisement that violates the terms or regulations without prior notice.
9. Limitation of Liability
The platform, services, and information provided are offered "as it is" and "as available" without any express or implied warranties. We do not guarantee that the platform will be error-free, uninterrupted, or suitable for any particular purpose.
The platform shall not be liable for any loss or damage resulting from:
- The use of the platform or reliance on any information or advertisements provided therein.
- Any delays, technical breakdowns, internet connectivity issues, or user behavior.
- The content of websites linked to the platform or access to them through it.
- Any inaccurate data provided by users.
Disclaimer of Claims: The user acknowledges the platform's release from any claims or losses arising from the inaccuracy of information provided by another user (the original party in the contractual relationship) or the failure of any party to comply with the terms of contracts concluded through the platform. The platform's role is limited to real estate brokerage only and it bears no legal or financial responsibility for any damage resulting from these causes.
Protection from Viruses: We are committed to making reasonable efforts to scan and test the contents of the platform to ensure their safety. However, we recommend the use of antivirus software when downloading any materials from the platform or from the internet in general. The platform shall not be held liable for any loss or damage resulting from viruses or technical malfunctions arising from the use of the platform or the downloading of its content.
You acknowledge that your use of the platform is at your own risk, and that your sole remedy for any damage or loss resulting from your use of the platform is to discontinue its use.
10. Remedies
The user agrees to indemnify and hold [Waseet Alkol] Platform, its management, employees, and agents harmless from any liability or claim arising out of the user's breach of the Terms of Use or violation of any applicable laws in the Kingdom of Saudi Arabia or the user's place of residence.
11. Intellectual Property Rights
All content available on the [Waseet Alkol] Platform, including but not limited to text, images, graphics, logos, and software, is protected under copyright, trademark, and other intellectual property laws in the Kingdom of Saudi Arabia. It is strictly prohibited to sell, license, modify, copy, reproduce, upload, or distribute any content from the Platform without prior written consent from the Platform's management. Any unauthorized use of the content may expose the user to legal liability.
12. Preventive Measures
In the event of a breach of the Terms, the Platform shall have the right to:
- Suspend or terminate the user's account.
- Remove the violating content.
- Report the violations to the competent authorities.
- Take legal action.
13. Termination of Use
[Waseet Alkol] Platform reserves the sole discretion to terminate, restrict, or suspend the user's account or access to the platform without prior notice in the following cases:
- Violation of the Terms and Conditions of Use.
- Illegal or harmful behavior towards the platform or its users.
The user has the right to terminate their use of the platform by providing prior notice via info@thewaseet.com.
14. Dispute Resolution and Jurisdiction
Disputes shall initially be resolved through good-faith negotiations by contacting the Platform's management within 15 days from the date the dispute arises. Disputes that are not resolved through such negotiations shall be referred to the competent courts in Riyadh. All claims and disputes arising from the use of the Platform shall be exclusively subject to the jurisdiction of the courts of the Kingdom of Saudi Arabia.
15. Modifications
- The Platform reserves the right to modify these Terms and the Privacy Policy at any time.
- Users will be notified of the modifications via the Platform or email.
- Continued use of the Platform after such modifications shall be deemed as implicit acceptance thereof.
16. Cybercrime Prevention
The Platform and all its electronic services are subject to the Anti-Cybercrime Law of the Kingdom of Saudi Arabia. The use of the Platform for any purpose that violates this law is strictly prohibited, including unauthorized access, data manipulation, or any activity that threatens the security of the Platform or its users.
